Open Records Requests

Wisconsin’s public records law (Wis. Stat. §§ 19.31-19.39) ensures government transparency and applies to local officials, such as alderpersons and board members, who are legal custodians of records related to their official duties (Wis. Stat. § 19.33). Records include emails, schedules, and newsletters, regardless of location or device, but exclude personal documents and drafts for personal use (Wis. Stat. § 19.32).

Officials must respond to requests promptly

(Wis. Stat. § 19.35(4)), and any denial must provide specific reasons. Violations, such as improper denials, can result in fines, damages, and legal fee reimbursement

(Wis. Stat. § 19.37).

This summary is based on insights from Claire Silverman, Legal Counsel for the League of Wisconsin Municipalities, published in The Municipality (January 2018).
